Terms of Use

These Terms govern your use of the Higher Human iOS app and higherhuman.app. By creating an account or using the app, you agree to them. If you do not agree, do not use Higher Human.

Higher Human is not medical advice. It is a wellness and fasting tracking tool. It is not intended to diagnose, treat, cure, or prevent any disease, and it is not a substitute for a doctor, dietitian, or other clinician.

You decide whether to fast. To the fullest extent the law allows, you are responsible for your own health decisions and for checking with a qualified clinician before major fasting or diet changes.

1. Who provides the service

Higher Human is provided by Hugo Matos, an individual in Ireland, trading as Higher Human (“we”, “us”). Contact: support@higherhuman.app. Higher Human is not yet commercially released. Before paid launch, the geographic business address and telephone contact required by Irish law will be published here and in our App Store trader information.

2. Relationship to Apple’s license terms

If you download Higher Human from the App Store, Apple’sStandard EULA applies to the app license between you and us. Apple is not the App Provider, but Apple and its subsidiaries are third-party beneficiaries as described in the Standard EULA. These Terms supplement the Standard EULA. Mandatory consumer law prevails over either document.

3. Eligibility (18+)

You must be at least 18 years old to create an account or use Higher Human. By using the app you represent that you meet this requirement.

4. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Higher Human on Apple-branded devices you own or control, as allowed by the App Store rules and these Terms. You may not copy, reverse engineer (except where mandatory law allows), rent, or misuse the app or our systems.

5. Accounts

Some features require an account (Sign in with Apple, Google, or email OTP). You are responsible for activity under your account and for keeping access to your sign-in method secure. Provide accurate information. Do not impersonate others.

6. Health and safety

Higher Human is a general wellness and self-tracking tool. It does not provide medical or dietetic diagnosis, treatment, monitoring, clearance, or personalised clinical advice. No doctor-patient, dietitian-client, or other healthcare-professional relationship is created.

  • Timers, stage labels, targets, estimates, companion messages, research summaries, and Tribe content may be incomplete, inaccurate, out of date, or unsuitable for you.
  • Do not use Higher Human to diagnose a condition, change medication, or delay professional care.
  • Fasting and OMAD can cause harm and are not suitable for everyone. Possible risks include dizziness, fainting, electrolyte problems, disordered eating patterns, medication interactions, and other adverse effects.
  • Obtain advice from a suitably qualified clinician before starting or materially changing a fast, particularly if you are pregnant or breastfeeding, take glucose-lowering or other relevant medication, have diabetes, have a history of disordered eating, or are under medical care.
  • Stop fasting and seek medical care if you feel unwell. Higher Human is not an emergency or continuous-monitoring service. In an emergency in Ireland, call 112 or 999. Elsewhere, call your local emergency number.
  • Onboarding questions and safety flags are product guardrails, not medical clearance.

You decide whether and how to fast. You are responsible for providing accurate information and following professional advice. This does not waive any duty we owe under law. Reading or acknowledging these warnings does not by itself mean that you voluntarily accept the risk of injury caused by our act or omission.

7. No outcome promise; accuracy limits

We do not promise weight loss, health improvement, metabolic outcomes, or any specific result. Streaks, XP, badges, altitude metaphors, and “pace to summit” are engagement and tracking tools, not guarantees.

Outputs depend on information you provide, device permissions, assumptions, and available source material. Check your entries and settings. Estimates are not measurements, medical findings, or guarantees. Nothing in this section reduces our responsibility for representations we make or obligations imposed by consumer law.

8. Subscriptions and in-app purchases

  • Premium may be offered through auto-renewing subscriptions or a one-time Founding purchase through Apple’s App Store.
  • Apple displays the price, billing period, trial, and renewal terms before purchase and processes payment through your Apple ID.
  • Subscriptions renew automatically unless you cancel in your Apple ID subscription settings at least 24 hours before the end of the current period (or as Apple’s rules then require).
  • Manage or cancel in iOS Settings → Apple ID → Subscriptions. Deleting your Higher Human account does not cancel an Apple subscription.
  • A one-time Founding purchase charges once and does not renew. It unlocks the Premium tier in this Higher Human app while that tier and service remain available, subject to remedies required by law. It does not include a separate successor product unless we say so expressly.
  • Restore Purchases is available in the app for purchases tied to your Apple ID.
  • Apple handles App Store billing and most refund requests. This does not reduce any mandatory remedy available to you under Irish or EU consumer law.

Cancellation rights

Where Irish or EU distance-contract cancellation rules apply, you normally have 14 days after the contract is concluded to cancel without giving a reason. For digital content supplied immediately, that right may be lost only after the legally required request, consent, acknowledgment, and confirmation. Nothing in these Terms is itself that request or acknowledgment. For Apple billing or cancellation, usereportaproblem.apple.com or Apple Support. You may also contact us. Apple’s process does not reduce rights that cannot be waived.

9. Tribe and user content

Tribe is a community of adult users. You keep ownership of content you post. You grant us a worldwide, non-exclusive license to host, display, moderate, and distribute that content in connection with operating Higher Human.

You agree not to post or share:

  • Medical advice presented as professional care, or content that encourages extreme, unsafe, or disordered eating practices
  • Illegal content, harassment, hate, threats, sexual content involving minors, or spam
  • Others’ private information without permission
  • Content that infringes intellectual property

We may remove content, restrict features, or suspend accounts. Reporting and blocking tools are available in the app. We are not obligated to monitor all content, but we may act on reports. Peer posts are not our advice.

Automated checks on your device may block obvious prohibited text before it is posted. Reports are sent to a moderation queue for review. We do not endorse or clinically verify Tribe content.

Illegal content and moderation under the EU Digital Services Act

  • Contact: recipients and authorities may contact support@higherhuman.app in English.
  • Notice and action: use the in-app Report control next to the content, or email us with the exact content or account, its location or screenshot, why you believe it is illegal, your contact details, and a good-faith statement that the notice is accurate. We will acknowledge sufficiently detailed notices and assess them in a timely, objective, and proportionate way.
  • Reasons: where required, a user whose content or account is restricted will receive the facts and rule or legal basis for the decision, whether automation was used, and available redress.
  • Challenge: you may challenge a moderation decision by emailing us within six months. You may also contact Ireland’s Digital Services Coordinator, Coimisiún na Meán, use an available certified out-of-court body, or go to court.
  • We may inform law enforcement where we become aware of information giving rise to a suspicion of a serious criminal offence involving a threat to life or safety, as required by law.

10. Acceptable use

Do not attack, scrape abusively, probe, or disrupt our systems or other users. Do not use Higher Human to harm anyone. We may suspend or terminate access for violations of these Terms or for safety and integrity reasons.

11. Third-party services

The app depends on third parties (including Apple, Google Sign-In, Supabase, and Giphy). Their availability and policies are outside our full control. Your use of those services may be subject to their terms.

12. Intellectual property

The Higher Human name, design, software, and non-user content belong to us or our licensors. These Terms do not transfer ownership to you.

13. Privacy

Our Privacy Policy explains how we process personal data. It forms part of how we operate the service together with these Terms.

14. Service standard and statutory rights

We will supply Higher Human with the conformity, reasonable care and skill, updates, and remedies required by applicable consumer law. We do not guarantee weight loss, health improvement, or any other personal outcome. We also cannot promise that every optional feature will always be uninterrupted or free from minor errors.

Nothing in these Terms excludes or restricts a statutory right or remedy.

15. Limitation of liability

We are responsible for loss or damage that is a reasonably foreseeable result of our breach of these Terms or failure to use reasonable care and skill.

To the extent permitted by law, we are not responsible for loss that was not reasonably foreseeable when the contract was made, business loss arising from use outside a consumer purpose, or loss caused solely by materially inaccurate information supplied by you where we did not cause or contribute to that loss.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our act or omission, fraud or fraudulent misrepresentation, your statutory remedies, or any other liability that cannot lawfully be excluded or limited.

16. Your responsibility

You are responsible for content you post and for complying with applicable law. If your intentional or negligent unlawful conduct causes direct loss, we may rely on remedies available under applicable law. These Terms do not create a general consumer indemnity or an automatic obligation to pay our legal fees.

17. Availability and events outside reasonable control

We may perform maintenance and cannot guarantee uninterrupted availability. Neither party is responsible for delay caused by an event genuinely outside that party’s reasonable control, provided that reasonable steps are taken to reduce the effect and notice is given where practicable. This does not remove a statutory cancellation, refund, conformity, or safety right.

18. Suspension, termination, and discontinuation

You may stop using the app and delete your account at any time (see Settings or email support@higherhuman.app). We may suspend or terminate access for a material breach, unlawful content, fraud, or a genuine security or safety risk. Except where immediate action is reasonably necessary or legally required, we will give the reason and a reasonable opportunity to correct the breach. Any action will be proportionate.

If we permanently discontinue the service for a legitimate legal, technical, or business reason, we will give reasonable advance notice where practicable. Cancellation, reimbursement, and other statutory rights remain available. Sections that by nature should survive, including intellectual property, liability, and governing law, survive termination.

19. Changes to these Terms and the service

We may change these Terms only for a valid reason, including a change in law, security or abuse prevention, clarification, or a new or changed feature. Changes will not apply retrospectively. We will give reasonable advance notice of a material change by email or in-app notice on a durable medium. If a change materially disadvantages you, you may cancel an ongoing paid service before it takes effect. We will request affirmative acceptance where required by law.

20. Applicable law and courts

These Terms do not deprive you of mandatory protections under the law of the country where you habitually live. A consumer may bring proceedings in any court available under applicable consumer-jurisdiction rules, and we may bring proceedings against a consumer only where those rules permit. Subject to those protections, Irish law applies and Irish courts have non-exclusive jurisdiction.

21. Notices, transfer, and general terms

Material notices from us will be sent to the account email or provided in-app on a durable medium. Keep your contact information current. We may transfer these Terms as part of a genuine transfer of the business or service only where the transfer does not reduce your rights. We will notify you if a transfer materially affects you. A claim may be brought within the period permitted by applicable law. These Terms do not shorten a statutory limitation period.

If a provision is unenforceable, the remainder continues to apply where it can do so lawfully. These Terms, the Privacy Policy, and applicable Apple terms form the agreement about Higher Human. Failure to enforce a provision is not a waiver.
